FORMAL NOTICE OF SYSTEMIC CONCERNS: VERIFICATION OF PUBLIC AUTHORITY, ENFORCEMENT RECORDS AND CONSEQUENT HARM
There is a sense of Lawlessness starting to creep in with the redirection of OIAs and delayed replies that say nothing of significance. Maybe they are getting tired?

FORMAL NOTICE OF SYSTEMIC CONCERNS: VERIFICATION OF PUBLIC AUTHORITY, ENFORCEMENT RECORDS AND CONSEQUENT HARM Related Ministry of Justice requests: 135990 and 136540
Dear Prime Minister and Responsible Officers,
1. PURPOSE AND STATUS
We request a substantive, coordinated consideration of recurring concerns recorded by our office about public administration, traffic and vehicle enforcement, court-related administration, disputed seizures, complaint handling and harm to individuals and businesses. Our objective is to improve the system, not undermine lawful enforcement. We do not allege that every disputed decision was unlawful or that an organised criminal enterprise has been established. The examples below are allegations or disputed matters requiring examination of primary records, not findings of wrongdoing. We deliberately withhold the identities of affected people and businesses in this general notice.
2. VERIFICATION BEFORE COERCIVE ACTION
Please identify existing records, policies and procedures showing how responsible agencies verify: (a) the correct person and legal liability; (b) notice and service; (c) outstanding challenges, reviews or hardship applications; (d) the statutory or contractual power relied upon and its preconditions; (e) the identity and authority of the decision-maker; and (f) the audit trail and human review before enforcement, seizure or arrest. A record entered into an administrative system should not be treated as self-proving.
3. MINISTRY OF JUSTICE REQUESTS 135990 AND 136540 We seek a clear reconciliation of outstanding questions in request 135990 and confirmation of the scope and applicable statutory response date for request 136540. An earlier Ministry response reported approximately 92,200 traffic- or vehicle-fine-related arrest warrants for 2021-2025. We seek the existing aggregate source, definitions and any available category breakdown, together with the relevant verification, correction and remission procedures. We do not assume that these warrants represent 92,200 individuals or predominantly parking matters. We do not seek a manual review of all warrants.
4. EXAMPLES REQUIRING PROPER EXAMINATION Our office has received reports of a disputed $120 charge following a very brief Queenstown Airport stop, with concerns about notification, escalation and alleged harassment. Please identify which authority imposed the charge and any Ministry-held complaint, referral or enforcement records, if any.
Other anonymised matters involve disputed transport regulatory decisions, vehicle removal, receivership actions, business interruption and threatened insolvency. The legal powers of NZTA, Police, private receivers and secured creditors are distinct and must be examined separately. We seek verification of the applicable power, its factual basis and available remedies rather than an assumption that a court order was invariably required.
We have also received an allegation of assault and removal of a wallet from a handcuffed person. This is a Police-conduct allegation requiring an appropriate separate referral and evidence review; it is not presented as an established fact or as conduct of the Ministry of Justice.
Further concerns involve inaccurate registration, ownership, road-user-charge and court-administration records. We ask NZTA to identify how records are checked and corrected and what independent review is available. We seek any existing relevant audits concerning consistent enforcement, including cases involving overseas operators; we do not assert unequal treatment by nationality without evidence.
5. USE OF RESEARCH AND DRAFTING TOOLS
Our office maintains records and works with people who review evidence and make decisions. AI is one administrative and research tool among others. The Ministry’s reference to ChatGPT in its clarification correspondence does not answer the substantive request. We accept the need to specify existing information with due particularity and ask that any genuine uncertainty be identified item by item. The method of drafting is not itself a reason to disregard an otherwise valid request.
6. ACCOUNTABILITY AND REMEDIES
Please identify existing procedures for correcting mistaken identity, defective notice, inaccurate ownership or liability, and improper escalation; notifying enforcement personnel of corrections; suspending or withdrawing enforcement where justified; reviewing payment arrangements, hardship and remission; and considering restitution or compensation where legally available. The harm alleged in these matters includes loss of income, property, businesses and financial security, and possible deprivation of liberty. We seek evidence-based assessment, not assumptions of liability.
7. ACTION REQUESTED
Within five working days, please acknowledge receipt and identify a responsible contact or referral point. We request a substantive response within 20 working days of receipt, addressing:
(a) which issues fall within your functions;
(b) the statutory or other lawful powers and verification safeguards relevant to those functions;
(c) existing responsive records and the basis for any refusal or withholding;
(d) the status of recorded complaints and corrective processes;
(e) any relevant systemic audit or improvement work; and
(f) any matter referred elsewhere, with the recipient identified.
Where the applicable law allows a different decision period, clarification or extension, please identify that position expressly. The 20-working-day request is not asserted to override statutory rules or the independence of courts or oversight bodies.
Please preserve relevant correspondence, decision records, system audit trails and complaint-handling records in accordance with applicable retention obligations. This general notice does not request disclosure of private case files to every copied recipient. We will provide case-specific material through appropriate confidential channels where authorised.
8. INSTITUTIONAL ROLES
We ask the Ministry of Justice to address its own administration and OIA matters; NZTA to address its transport records and enforcement systems; Crown Law to consider the concerns within its advisory and litigation functions; the Ombudsman to assess whether matters warrant consideration within its independent statutory jurisdiction; and the Prime Minister’s office to consider whether a cross-agency administrative response or referral is appropriate. We recognise that no one recipient can adjudicate every complaint and that judicial decisions and Police conduct have distinct review mechanisms.
We are trying to help the system work lawfully, accurately and fairly. A system that demands compliance from the public must also be able to demonstrate its own.
Please respond substantively, with identified responsibility and practical next steps.
Yours sincerely,
Tracy Lynch
