Are we at the position where we can take this to court – Roadside Drug testing
This OIA regarding the roadside rug testing has given us a few more questions to be answered still but if anyone wants to use this information please go ahead an o so.
We have enough evidence to take to a public-law barrister for a serious assessment of court action. I would not yet describe what we have as a case ready to file.
The new documents give us concrete issues to investigate. But we still need to connect those issues to a specific unlawful decision or action, identify who would bring the case, and decide what order we want from the court.
I also need to qualify my earlier assessment: Police involvement and incomplete scientific answers do not, by themselves, establish illegality. Nor does missing information in this release establish that ministers never received it.
