DRAFT MEETING MINUTES & PROPOSED RESOLUTIONS

Meeting date: Tuesday, 20 October 2026  | Time: 8.pm |  Venue: online

VERSION 4 — Draft meeting minutes and proposed motions for Michael and Council members. The Chairperson’s three-week report appears immediately after opening formalities for reading aloud. Attendance, votes and decisions are not yet confirmed.

1. Opening and meeting particulars

Chairperson: __________   Secretary/minute-taker: __________   Members present: __________   Apologies: __________   Quorum confirmed: Yes / No / Pending

2. Chairperson’s three-week report — (29 September–20 October 2026)

Chairperson’s prepared report for presentation at the beginning of the meeting. Members may ask questions and request corrections. This report records progress and outstanding issues; it is not a record of resolutions already passed.

The Council acknowledges that regular weekly reporting was interrupted during an unusually demanding period of court activity, agency correspondence, research and records review. Work continued throughout the three weeks. The priority is to restore predictable weekly written reports while preserving the progress already made.

Progress in records and evidence

The Council has continued collecting and cross-referencing original correspondence, court filings, agency decisions, witness material and legal authorities. Its existing records register supports case histories, responses, results, unanswered questions and further actions. An unanswered question does not itself establish misconduct.

MSD — pensions and statutory questions

The continuing pension inquiry concerns statutory authority, application forms, receipt and treatment of documents, and the adequacy of official responses. After lengthy correspondence, MSD described a further information request as frivolous or vexatious. That refusal and the underlying outstanding questions have been challenged and escalated; the substantive issues remain unresolved.

MPI — livestock, horse ownership, forestry and carbon credits

Work continues on animal welfare and ownership records, including questions concerning the stallion Tuscan, relevant orders, sale documentation and disclosure. A separate forestry/carbon-credit issue involves classification, payment and a reported acknowledgement of error; the precise effect and any entitlement remain to be verified.

IRD — financial and tax verification

The Council continues reviewing disputed classifications of transactions, GST and income allegations, incomplete banking records and reconciliation requirements. A substantial transaction record has been assembled; further source documents and verification are needed.

NZTA, transport enforcement and commercial losses

Transport matters under review include licensing, enforcement decisions, vehicle seizures, receivership, insolvency and claimed business losses. The Council is examining the particular statutory authority and evidence for each action; general enforcement responsibility alone is not proof of an impoundment power. Allegations and loss amounts remain subject to verification.

Police, vehicle seizure and judicial review

Active matters raise questions about search and seizure powers, ownership, missing paperwork, disclosure, section 147 applications and judicial review. A further reported vehicle taking and the completeness of associated records require case-specific verification. No finding of unlawful taking is recorded at this stage.

District Court notices, service and access to records

Across several matters, parties have reported gaps in notices, court minutes, document distribution and proof of service. The Council is seeking dates of filing and transmission, complete document lists and evidence of notification, including questions raised about the Marton District Court record. Each concern will be checked against the applicable court rules and source correspondence.

Family Court, property and local authorities

Work continues on child welfare and due-process concerns, rates, title, drainage, trusts, land use and council decisions. Confidentiality, safeguarding and documentary verification remain essential.

Outstanding organisational work

The existing records function is operating well. The Council proposes to minute its continuation, restore weekly progress synopses, allow members to raise questions at any time, track assigned tasks, elect or confirm a functioning Treasurer and consider monthly financial reports. No Treasurer’s report is presently available.

Overall position

The three-week period has produced more organised records, clearer legal and evidential questions, continuing follow-up and a stronger basis for accountability. Many outcomes remain pending. The Council’s next priority is consistent reporting, properly recorded motions, accountable task allocation and verification of outstanding responses.

Considerable work continues across agency correspondence, court matters and evidence review. Two recent weekly newsletters were missed during exceptional workload. Regular written synopses are proposed.

MSD pension matters

A lengthy correspondence history includes disputed statutory questions and a refusal described as frivolous or vexatious. Follow-up and escalation have been reported; exact outcomes remain subject to the case record.

Transport and Police vehicle seizure

Further questions have been raised about statutory authority, documentation and reported vehicle seizures. The relevant powers and facts require verification case by case.

District Court notices and records

Reported gaps in service, notification, filing dates, minutes and disclosure require a case-by-case audit and written confirmation of when records were received and circulated.

Records and legal authorities

The existing records function is operating and should continue. Its maintenance and purpose should be formally minuted: case records, correspondence, evidence, court decisions, results, outstanding information and next actions.

Active casework

MPI, MSD, IRD, NZTA, Police, courts, property and local-authority matters remain under review. Reports should distinguish completed work, unresolved matters and next steps.

Financial sustainability

No current Treasurer’s report is available. The Council needs to elect or confirm a functioning Treasurer and consider monthly financial reports. Chris’s earlier draft has not been approved as a business plan.

Member participation

Members are invited to indicate their skills, availability and areas in which they can assist.

Council executive officers — proposed roles and responsibilities

The Council executive consists of the officers elected or appointed under its governing documents. The following responsibilities are proposed for discussion and confirmation; they do not override the trust instrument or any existing delegated authority.

Chairperson: Chairs meetings, ensures members can contribute, confirms that motions are properly considered and voted on, oversees agreed actions and works with the Secretary on agendas and meeting procedures.

Secretary: Prepares and circulates agendas, receives written motions, takes accurate minutes, records the exact wording and outcome of votes, maintains the resolutions and action register, and coordinates weekly progress reporting.

Treasurer: Maintains accurate records of money received and spent, keeps supporting financial documents, prepares a proposed monthly financial report, identifies financial commitments and presents expenditure for approval under the Council rules. No current Treasurer report is available.

Executive collectively: Implements valid Council resolutions, protects confidential records, reports progress, discloses relevant conflicts of interest and remains accountable to members. Tasks and decisions should be documented rather than assumed.

Proposed action: Confirm the duties, officeholders, reporting arrangements and any limits on authority after checking the Council governing documents. Record the agreed responsibilities and election outcomes in the minutes.

4. Motions submitted for consideration (not yet adopted)

Motion 1 — Written motions, weekly agenda and minutes

That proposed motions ordinarily be submitted in writing to the Secretary and Chairperson before a meeting; that members have an opportunity to consider and discuss them; that amendments be settled before the vote; that the final wording be read or otherwise confirmed before voting; and that the Secretary record verbatim the exact motion voted upon, the result, and any assigned actions. A weekly agenda, meeting minutes and action register shall be maintained, subject to the governing rules.

5. How motions are to be recorded

The written proposal is the starting text. During the meeting, members may propose changes in accordance with the governing rules. Before voting, the precise final wording must be confirmed. The minutes must reproduce that final wording exactly and record whether it was carried, lost, withdrawn or deferred. Do not substitute the original draft for an amended motion.

6. Outstanding issues and action follow-up

  • Verify court notification and distribution records for each affected case.
  • Identify outstanding agency replies and statutory questions.
  • Maintain case evidence and results in the existing register.
  • Confirm Treasurer nominations and the financial reporting process.
  • Confirm meeting day and the weekly newsletter/reporting timetable.
