Ministerial Climate Interests

Christopher Luxon and relevant Ministers – financial interests, conflicts and decision participation

Working Paper A | 4 October 2026

NOT A LAWYER | Research and verification document

Purpose: establish the documentary record first, distinguish evidence from inference, and identify the records required to test each proposition.

1. Question under investigation

Did the Prime Minister, a declared trust, managed investment, retirement scheme, or another declared interest have any direct or indirect financial exposure capable of being affected by Government decisions concerning the Paris Agreement, New Zealand’s NDCs, international climate finance, offshore mitigation, carbon markets or the NZ ETS; and, if so, was any conflict identified and managed?

Important evidential boundary
No finding of personal profit or improper conduct is made. A broad managed fund may hold many companies; that fact alone does not establish a material conflict. The task is to identify a specific interest, a specific decision, a plausible financial nexus, and the applicable disclosure or conflict-management record.

2. Evidence already identified

The Cabinet Office published a summary of ministerial conflict-management arrangements for 1 January to 30 June 2026. It explains that the public table includes certain transfers and standing arrangements, but does not include every declaration or ad hoc/short-term arrangement. The published table contains conflicts for a number of ministers; it is therefore not a complete substitute for targeted records concerning particular decisions.

Treasury has separately published 2026 work estimating potential fiscal costs associated with purchases of offshore mitigation towards New Zealand’s Nationally Determined Contributions under the Paris Agreement. This establishes a substantial public-finance decision stream that can be matched against ministerial participation and declared interests.

3. Forensic work programme

1. Collect annual Registers of Pecuniary and Other Specified Interests for Christopher Luxon for each available year from entry to Parliament through 2026, and create a change log.
2. Identify every disclosed company interest, trust, property interest, managed fund, ETF, KiwiSaver/retirement scheme, directorship, creditor/debtor interest and other relevant category.
3. For pooled funds, obtain public portfolio/mandate information. Record climate, energy, carbon-market, infrastructure and financial-sector exposure, while distinguishing broad index exposure from concentrated holdings.
4. Create a decision register for Cabinet and ministerial decisions involving Paris, NDC1/NDC2, Article 6, international climate finance, offshore mitigation, NZ ETS settings, climate funds and major climate appropriations.
5. For each decision, identify whether Luxon received papers, attended, participated, approved, delegated, recused, declared an interest, or was subject to a conflict-management arrangement.
6. Repeat the same test for Ministers holding Finance, Climate Change, Environment, Foreign Affairs, Energy/Resources and Trade responsibilities.
7. Only escalate a potential nexus where a declared interest can be connected to an identifiable beneficiary, counterparty, security or economic exposure affected by a decision.

4. Records to request

• Cabinet Office/DPMC records of declarations, advice, recusals, transfers or conflict-management arrangements concerning the specified climate matters.
• Lists/titles of Cabinet papers and minutes in which the Prime Minister participated on NDCs, offshore mitigation, international climate finance, Article 6 and NZ ETS matters.
• Any advice to Ministers on whether declared trusts, funds, retirement schemes or investments created actual, potential or perceived conflicts for those decisions.
• Where withholding is claimed, the schedule of documents, date, author, recipient, subject and statutory withholding ground.

5. Verification test

For every alleged nexus ask: What interest? Who owns it? What was its value/exposure? What decision? What date? What legal authority? What identifiable financial effect? What declaration was made? What conflict advice was given? What action was taken? What record proves each answer?
