Official Information Act 1982 Request
Road Corridor Revenue, Ownership and Accounting Treatment
Follow-up to OC260440
Version 0.03 | 22 August 2026
To: Official Information / Revenue Team
Ministry for Cities, Environment, Regions and Transport

Dear Sir/Madam,
This is a focused follow-up to OC260440.
The issue is straightforward: where land is acquired, taken, transferred, dedicated or vested for road purposes, and that land later generates revenue or other economic value, I seek the existing records showing who receives that value, how it is accounted for, and the legal basis for that treatment.
I am not asking the Ministry to create a new legal opinion.
1. Revenue generated from road corridors
Please provide existing records identifying revenue or economic benefit derived from road corridors, including:
tolls;
road-user charging;
leases and licences;
utility occupation charges;
telecommunications and fibre access;
advertising or concessions;
parking or access charges;
commercial occupation;
value-capture mechanisms; and
any other recurring or capital revenue attributable to use of the road corridor.
For each category, please identify:
the collecting entity;
the receiving entity;
the accounting destination;
the statutory or contractual authority;
and the annual amount received.
2. Underlying land interests
Please provide records addressing whether acquisition or vesting of road land extinguishes:
beneficial interests;
equitable interests;
customary interests;
reversionary interests;
future revenue rights;
future commercial interests; or
any entitlement arising from subsequent use of the corridor.
Where any such interest is said to be extinguished, please identify the precise statutory provision, instrument, deed, proclamation or other authority relied upon.
3. Compensation and future value
Please provide records explaining whether compensation paid at the time land was acquired was intended to extinguish all claims to future value generated from that land, including:
toll revenue;
utility access;
telecommunications use;
commercial occupation;
licensing revenue;
revaluation gains; and
other subsequent economic uses.
If the Crown’s position is that the initial acquisition permanently transfers all future economic benefit to the Crown or another public entity, please provide the records establishing that position.
4. Accounting treatment
Please provide the relevant accounting policies, Treasury guidance, NZTA guidance or audit material showing:
how road land is recorded as an asset;
how it is valued or revalued;
where related revenue is recorded;
who receives any revaluation benefit;
and whether any liability or obligation to former owners or beneficial interests is recognised.
5. Reciprocal value capture
OC260440 disclosed work concerning value-capture mechanisms where public transport investment increases private land value.
Please provide any records considering the converse position:
where land contributed to the road network creates ongoing economic value for the transport system, whether any part of that value should be recognised, attributed or returned to the persons or interests from whom the land derived.
If no such analysis exists, please confirm that no responsive record was located.
6. Māori, trust and beneficial interests
Please provide records dealing specifically with road land derived from:
Māori land;
trust land;
land subject to beneficial ownership;
customary interests; or
other land where legal and beneficial ownership were not identical.
Please identify whether any ongoing revenue or economic benefit is attributed to those interests and, if not, the legal basis for that position.
7. Road stopping or disposal
Where a road is stopped, sold, transferred or no longer required for its original purpose, please provide records identifying:
who receives the land;
who receives the sale proceeds;
whether former owners or successors have any right of first refusal or reversionary interest;
and how any proceeds are accounted for.
8. Core accounting question
Please provide the existing records answering the following:
If land formerly held by another person or interest becomes road land and subsequently generates revenue or capital value, who receives that value, under what authority, and why is no proportion attributed to the former or continuing interest in the underlying land?
If the answer differs depending on the method by which the land became road, please identify each category separately.
Search and transfer
Please search the records reasonably likely to contain responsive material, including legal, accounting, revenue, transport-funding, Crown-property, Public Works Act, Cabinet, NZTA and Treasury records.
Where another agency is more likely to hold a discrete part of the information, please transfer that part under section 14 of the Official Information Act 1982.
If information is withheld, please identify the specific statutory ground relied upon.
If no responsive record exists, please say so expressly.
Thank you.
