URGENT — Michael Clark NZ Superannuation — Final Statutory Authority Demand and Pre-Action Notice
We are not playing games with these guys, and they know it.
This is a serious issue they do not have the authority to administer our pension, that is tax it or delete from it in any shape or form, unless you sign the M12. The fact that everyone has is because it was not explained to you all in complete detail. We had to look at the wording very carefully. Its bloody clever deception, its a scam.
Dear Ministry of Social Development,
Please treat this as the same formal escalation sent immediately prior, now copied to [email protected] for the evidential record.
There are two separate matters requiring response.
FIRST — FINAL STATUTORY AUTHORITY QUESTION
MSD has confirmed that it received the documents Michael Clark submitted at Queenstown Community Link on 31 October 2025, but maintains that those documents could not be accepted in place of a completed New Zealand Superannuation application form.
Please identify:
1. the precise form or declaration MSD says Michael was required to sign;
2. the exact statutory provision making that signature compulsory;
3. the statutory consequence of declining or disputing that form;
4. the identity of the decision-maker who determined that Michael’s pension would not be paid;
5. the date and written reasons for that decision; and
6. the review or appeal rights attached to it.
Administrative practice is not, by itself, statutory authority.
If MSD cannot identify a statutory provision requiring the signature, please state that expressly.
A further extension of time or referral back to the application process will not answer the question.
SECOND — FORMAL PRE-ACTION NOTICE / $150,000 RESOLUTION DEMAND
Michael’s position is that material statements subsequently made or adopted by MSD concerning the 31 October 2025 interaction are false, misleading, unsupported by primary evidence, or materially incomplete. Contemporaneous video/audio and first-hand evidence exist and must be reconciled against MSD’s later official account.
The existing NZD $150,000 compensation/resolution demand is maintained. It concerns the disputed official account, handling of Michael’s documents, prolonged failure to answer the statutory-authority issue, alleged mischaracterisation of his conduct, distress, consequential loss, and time and expense incurred pursuing correction. The amount is a resolution demand and is separate from any pension arrears lawfully due. All rights to amend the amount once losses and arrears are fully quantified are reserved.
MSD is required to preserve all relevant records, including pension and application records, case notes, decision records, staff emails and internal messages, security and incident records, visitor records, correspondence, telephone records, metadata, records concerning the documents presented on 31 October 2025, and records concerning any use of ‘sovereign citizen’ terminology.
Please acknowledge receipt, identify the senior responsible officer handling this matter, and provide a substantive evidence-based response.
All rights are reserved.
Regards,
Tracy Lynch
