This is an example of the run around we get. This is hiding facts about RUCs
We sent this OIA out to look at the effects of the change from fuel tax to a Road User Charge system. Common sense tells us that the change will have us paying even more to pay off our 30 Billion $ debit. Created by Labour for a non existent pandemic.
Get ready they are going to do it again.
This wont be their last reply.
Re: Final response: Official Information Act request OC260440
Dear Harry,
Thank you for your clarification regarding OC260440.
For the record, I understand MCERT now formally confirms that the use of s 9(2)(g)(i) in Document 9 was an administrative error, and that the intended withholding provision was s 9(2)(f)(iv).
Please ensure that this correction is formally recorded against OC260440 and retained with the original decision, document schedule, released material and complete correspondence history.
I also ask that the original release record be corrected or annotated so that a later reader is not left with two inconsistent withholding grounds.
Document 14
Your response states that Document 14 remains withheld under s 9(2)(f)(iv) because the material discussed remains under active consideration.
That does not fully address the question I asked.
My request was specifically for MCERT to reconsider whether factual, background, administrative, historical, date, title, recommendation or other non-sensitive material could be released in part.
Please therefore confirm:
whether MCERT has conducted a specific partial-release and severability assessment of Document 14;
whether each section or substantive part of the document was separately considered;
what factual, historical, administrative or non-sensitive material was identified;
why release of that material would prejudice the interest protected by s 9(2)(f)(iv);
what particular policy or decision-making process remains under active consideration;
whether there is an anticipated decision or completion date for that process; and
what public-interest considerations favouring disclosure were identified and weighed against the interest relied upon under s 9(2)(f)(iv).
If MCERT’s position is that every substantive part of Document 14 must remain withheld, please confirm expressly that this conclusion followed an actual severability assessment rather than application of the withholding ground to the document as a whole.
Please also advise whether Document 14 will be reconsidered for release once the relevant policy or decision-making process is complete.
If that process concludes while this correspondence or any Ombudsman review remains underway, I request that MCERT reconsider the withholding at that point without requiring a completely new request.
Finally, please preserve this complete email chain, the original OC260440 request, the released documents, document schedules, internal decision and review records, and all subsequent correspondence as part of the permanent OIA history.
regards,
Michael

I can advise that the use of section 9(2)(g)(i) in document 9 was due to an administrative error. The correct section code should have been 9(2)(f)(iv).
In relation to document 14 I can advise that our treatment remains the same. The material discussed in the document remains under active consideration, as a result has been withheld under section 9(2)(f)(iv) of the OIA. I note that the title and date were both released to you as part of the document schedule.

Subject: Re: Final response: Official Information Act request OC260440Summary
Follow-up clarification on OC260440. This asks MCERT to confirm whether section 9(2)(g)(i) was relied on in Document 9, because that ground appears in the released material but not in the covering decision letter. It also asks MCERT to review Document 14 for partial release of factual, background, administrative, date, title, recommendation, or non-sensitive content.

Official Information Act 1982 Follow-up Request
Hello,
Thank you for the final response to OC260440.
I request clarification on two points.
First, Document 9 appears to contain a redaction marked s 9(2)(g)(i), but the covering decision letter only explains reliance on sections 9(2)(a), 9(2)(f)(iv), and 18(d). Please confirm whether s 9(2)(g)(i) was relied on, identify the information or document parts to which it applies, and provide the public-interest balancing considered for that ground.
Second, for Document 14, OC241450 Briefing – Fleetwide transition to RUC – Cabinet paper, withheld in full under s 9(2)(f)(iv), please review whether any factual, background, administrative, date, title, recommendation, or non-sensitive content can be released in part.
Kind regards
