Re: CASE-032461 (GROUND-0038781) – Letter dated 7 August 2026

Mr Martin,

Thank you for your email and attached letter dated 7 August 2026.

I have received your decision and am presently reviewing both the procedural and legal basis upon which it has been made.

At this stage, I do not intend to address each of the individual complaints referred to in your letter. Before doing so, I seek clarification regarding the process adopted by the Office in reaching the decisions contained in your letter, particularly the decision to impose restrictions on my future communications with the Office.

Your letter states that future correspondence, including certain complaints and emails, may be placed on file without response and that specific conditions now apply to any future complaints I submit.

Letter to Tracy Lynch – Addressing all complaints (7 August 2026).pdf

Before I can properly consider my position, I respectfully request that you identify:

The statutory authority, policy, guideline, or delegated power relied upon to impose these communication restrictions.

The decision-maker responsible for imposing those restrictions, including any delegation of authority under which the decision was made.

Whether these restrictions constitute an administrative decision capable of review or reconsideration, and if so, what process is available.

Whether I was afforded an opportunity to make submissions specifically on the proposed restrictions before the decision was made, and if so, what material the Office relied upon in concluding that such an opportunity had been provided.

Whether the restrictions were determined individually in relation to each complaint or whether they were based upon the cumulative volume and nature of my correspondence generally.

Your letter refers to previous correspondence and states that I did not engage with requests made by the Office. Letter to Tracy Lynch – Addressing all complaints (7 August 2026).pdf While I acknowledge those statements, I am seeking to understand whether the Office considered that correspondence sufficient procedural notice that the significant restrictions contained in the 7 August 2026 decision might subsequently be imposed.

I also note that the letter acknowledges the complaints concern different agencies, different issues, and different individuals, while at the same time referring to an overall pattern in my correspondence. Letter to Tracy Lynch – Addressing all complaints (7 August 2026).pdf I therefore seek clarification as to whether each complaint was independently assessed on its own merits before decisions were reached, or whether the overall assessment of my communications materially influenced the outcome of individual complaints.

For clarity, this request is not intended as a challenge to every conclusion reached in your letter. Rather, it seeks to understand the legal and procedural basis upon which the Office exercised its discretion before I decide whether further review or submissions are appropriate.

I would appreciate your response before I address the individual complaint files in detail.

Tracy Lynch
