Formal Request for Parliamentary Scrutiny — MPI Warrant Authority and Michelle Walker

Share on FacebookShare on XInteractive reader

Dear Speaker, Clerk, Chair, and Members,

Please find attached a formal request for parliamentary scrutiny concerning the Ministry for Primary Industries, the search-warrant process relied upon in the case against Michelle Walker, and the wider issue of accountability where coercive authority is exercised through unidentified numbers, codes, stamps, or opaque authorising notations.

The attached document asks Parliament to examine:

who applied for and issued the relevant warrant;

how the issuing officer’s identity and authority can be independently verified;

whether the complete warrant, execution, seizure, property, continuity, and return records exist;

whether seized or copied information was later supplied to or used with Fonterra, NAIT, Police, or other third parties;

who reviewed any defects raised in the investigation; and

who is ultimately accountable where the responsible agency and Minister have not provided a complete answer.

This matter is being referred to Parliament because the Cabinet Office has stated that Ministers are accountable to the House of Representatives for the agencies within their portfolios. Previous requests to Members and executive agencies have not resolved the underlying accountability and evidential issues.

The attached request does not ask Parliament to assume that every alleged defect has already been proved. It asks for the preservation and production of the primary records required to establish what occurred.

Please:

confirm receipt of this correspondence and attachment;

identify the appropriate parliamentary office, committee, or Member responsible for progressing it;

preserve this correspondence as part of the parliamentary record;

advise whether the matter will be referred to the Petitions Committee or another appropriate select committee; and

identify the process for having the accompanying request formally presented to the House.

The matter concerns an active case against Michelle Walker and raises broader questions about the traceability, authentication, supervision, and accountability of warrants exercised by public agencies.

Please ensure that the attached questions are considered as written and are not reduced to a general explanation of agency warrant procedures.

Yours faithfully,

Tracy Lynch
