Re: DOIA-REQ-0036306-Tracy Response CRM:0302106
MBIE has confirmed that it holds information-sharing agreements with New Zealand Police and the Department of Corrections concerning immigration status and criminality. Those agreements were expressly covered by my original request, but they were not supplied and no OIA withholding ground was identified.
Please provide:
the complete current agreements;
every version operating between 1 January 2020 and 31 December 2025;
all schedules, appendices and operational protocols;
the statutory authority for each agreement;
the names and positions of those who authorised and signed them;
the rules governing what information is shared, when it is shared, who may access it, whether the affected person is notified, and how misuse or inaccuracies are corrected;
any privacy assessment, ministerial approval, Privacy Commissioner consultation, audit or review document.
Please also confirm whether each agreement is an approved information-sharing agreement under the Privacy Act 2020, a memorandum of understanding, or another form of administrative arrangement.
If any material is withheld, identify the exact OIA provision relied upon and release the remainder with only necessary redactions.
An inter-agency agreement cannot create powers that Parliament has not authorised. The public is entitled to know the legal authority, limits and safeguards governing the sharing of personal information that may lead to immigration enforcement or deportation.
Please treat this as completion of the original request.
