Failure to Answer the Questions as Written — Crown Authority and Accountability
Thank you for your letter dated 4 August 2026.
Your response does not answer my notice in the form in which it was submitted.
The questions in my notice were deliberately written and carefully framed. I did not authorise the Cabinet Office, Government House, or any other official to rewrite, narrow, reinterpret, or substitute those questions with questions that were easier to answer.
Although your letter repeats the wording of the seven headline questions, the answers materially change their meaning and scope. In particular, my request for identification, substantiated proof, instruments, a traceable chain of authority, and accountable persons has been reduced to a general explanation of constitutional monarchy and a list of possible complaint bodies.
That is not an answer to the questions as written.
My first question was:
“Who is the man identified as the King, and by what instrument is this established?”
It was not:
“Who currently holds the constitutional title of King?”
Nor was it:
“What legislation recognises the Sovereign as New Zealand’s head of State?”
Those are different questions.
Your response identifies a title and refers to constitutional documents. It does not adequately identify the living man, the precise legal capacity in which he acts in relation to New Zealand, the instrument by which that man acquired or accepted that capacity, the limits of the authority exercised in his name, or the accountability attaching to him and those acting under that name.
I therefore require the original question to be answered exactly as asked.
Please identify:
The full legal identity of the living man described in New Zealand law and administration as “the King.”
The precise legal capacity in which that man is said to act in relation to New Zealand.
Whether “the King,” “the Sovereign in right of New Zealand,” “the Crown,” and Charles Philip Arthur George are the same legal person or are distinct offices, capacities, institutions, or legal concepts.
The specific instrument by which that identified man acquired, accepted, inherited, or was vested with authority in relation to New Zealand.
The legal act and date by which that authority became effective.
Whether that man personally accepted any office, obligation, oath, undertaking, compact, commission, or responsibility specifically relating to New Zealand.
The authenticated record of any such acceptance, oath, undertaking, or consent.
Whether authority exercised by Ministers, departments, courts, Police, prosecuting agencies, Crown solicitors, and other officials is the personal authority of that man, authority attached to the office of Sovereign, statutory authority created by Parliament, or authority independently held by those institutions.
Why the name and title of the King are used in prosecutions, enforcement actions, court proceedings, appointments, warrants, and exercises of coercive public power where the identified man has not personally considered, authorised, or accepted responsibility for the particular action.
Who is personally and institutionally accountable when authority exercised in the name of the King or Crown is misused, due process is not followed, evidence is withheld, delegations are exceeded, or harm is caused.
Whether the identified man has any process for receiving, considering, referring, investigating, or responding to evidence that authority exercised in his name has been misused.
If he has no personal responsibility for conduct undertaken in his name, the precise person or office that assumes that responsibility.
If responsibility is divided between several offices, the complete chain of responsibility and the office that is ultimately required to act.
The same problem applies to the remaining questions.
I did not merely ask for a list of possible oversight bodies. I asked what oversight exists where agencies investigate, prosecute, and review their own conduct.
Listing the Ombudsman, Privacy Commissioner, Parliament, audit processes, appeal rights, and the courts does not answer what happens where those bodies decline jurisdiction, refer the matter elsewhere, lack enforcement power, or leave the agency complained of to determine whether it has acted properly.
I also did not ask for general information about Crown land. I asked what authority governs gifted land arrangements, including the original conditions, rights of return, and consent of the original grantors.
Referring me generally to Land Information New Zealand does not identify the gift instrument, the conditions attached to the land, any lawful variation of those conditions, any right of reversion, or the consent relied upon for later use or transfer.
My original notice expressly required a substantive response identifying the relevant instruments, authorities, responsible offices, and any limitations. It also stated that merely referring to “the King” or “the Crown” does not, by itself, establish lawful authority.
Those requirements formed part of the questions and cannot properly be removed from them.
Please therefore respond to the original notice as written, rather than to a narrower version constructed by the Cabinet Office.
For the avoidance of doubt:
I do not consent to my questions being rewritten.
I do not accept a substituted question as an answer to the original question.
I do not accept general website material as substantiated proof of a specific chain of authority or accountability.
I require each question to be answered according to its ordinary wording and full context.
Any materially different interpretation relied upon must be expressly identified, together with the legal authority for adopting that interpretation.
If you consider any part of the original wording ambiguous, please identify the precise words said to be ambiguous and explain the interpretation adopted. Do not silently replace the question with another question.
If the Cabinet Office does not hold the requested records or lacks authority to answer, please state that directly and identify the office that is legally responsible for providing the answer.
This remains a request for a clear answer to a simple but fundamental issue:
Who is the living man whose name and title are invoked throughout New Zealand’s public administration; what precise authority does he hold; by what instrument does he hold it; how is that authority passed to those acting in his name; and who is answerable when that authority is misused?
Please answer the questions that were submitted, not questions selected or reformulated by the responding office.
Yours sincerely,
Tracy Lynch
