Kia ora,

Thank you for your response to my Official Information request dated 15 May 2026.

Having reviewed your reply, I am seeking clarification and reconsideration of several aspects of the decision, as there appear to be a number of internal inconsistencies.

Questions 2, 4, and 8 each contain statements that Council “does hold” or “does have” the information requested, yet the request is then refused under sections 17(e) or 17(g) of the LGOIMA on the basis that the information does not exist.

For example:

Question 2 states:

“Council does have this information”

but then declines the request under section 17(g) on the basis that the documents do not exist.

Similarly, Questions 4 and 8 state that Council holds the information, but then refuse the request under section 17(e) on the basis that the information requested does not exist.

These positions appear mutually inconsistent. If the information is held by Council, then sections 17(e) and 17(g) would not appear to apply. If the information does not exist, Council cannot simultaneously state that it is held.

I therefore request clarification as to:

  1. Whether the information requested in Questions 2, 4, and 8 exists.
  2. If the information exists, whether Council intended to release it and whether the refusal grounds cited were applied in error.
  3. If the information exists but is being withheld, the specific statutory withholding grounds relied upon.
  4. If the information does not exist, an explanation as to why the response states that Council holds or has the information.

In relation to Question 3, my request was not limited to revenue received by Council.

The request sought any documents, forecasts, estimates, briefings, analyses, correspondence, or reports concerning infringement revenue, enforcement activity, camera enforcement, Police enforcement, enforcement targets, or expected enforcement outcomes associated with speed-limit reductions.

Accordingly, I request confirmation as to whether Council holds any such documents, regardless of whether Council itself receives infringement revenue.

I also note that Council advises it obtained approval from the Director of Transport on 12 December 2025 pursuant to the Land Transport Rule: Setting of Speed Limits 2024.

Please confirm whether Council supplied any supporting material to obtain that approval, including but not limited to:

• Crash data;
• Safety assessments;
• Risk assessments;
• Engineering reports;
• Speed-management assessments;
• Technical advice;
• Internal recommendations;
• Correspondence with NZ Transport Agency Waka Kotahi or the Director of Transport.

If such material exists, please treat this email as a request for that information under the LGOIMA.

I would appreciate a reconsideration of the response before I determine whether referral to the Ombudsman is necessary
