Formal memorandum concerning the Gene Technology Bill and proposed regulatory framework.
Hello all,
Please find attached a Formal memorandum concerning the Gene Technology Bill and proposed regulatory framework.
This is provided as a formal complaint / pre-litigation notice and request for urgent review. The memorandum raises serious public-law concerns about the failure to provide the contract, authority, financial-benefit, safety, harm, liability, compensation, and audit trail connected to the Gene Technology Bill.
The central issue is not merely whether gene technology is supported or opposed. The issue is whether the Crown and responsible agencies have lawfully defined “safe”, disclosed what “harm” includes, identified who benefits, identified who carries the risk, and provided the public with the records required to verify that no physical, financial, environmental, food-chain, export, property, or bodily harm will be caused or externalised.
For the purposes of this notice, “safe” is interpreted to mean that the proposed regime will not cause harm, including bodily harm, financial loss, contamination, loss of food integrity, loss of consumer choice, loss of export value, legal cost, environmental harm, or non-consenting exposure.
If the Crown or any responsible agency uses “safe” differently, then that definition and the evidential basis for it must be disclosed.
The memorandum also requests disclosure of who signed, authorised, recommended, approved, contracted for, or financially benefited from the proposed regime, including all relevant Ministerial, departmental, Cabinet, procurement, lobbying, conflict-of-interest, liability, indemnity, insurance, and compensation records.
The matter is urgent because, once gene technology activities are authorised, released, embedded, commercialised, planted, consumed, patented, exported, or mixed into food and environmental systems, any harm may be difficult or impossible to reverse.
