Questioning Who the Crown says held sovereignty
There is a portion of the population that understand that we lost our Govt in 1986
To whom it may concern,
This is a request for official information under the Official Information Act 1982.
Please provide the official documents, legal advice, policy papers, briefing papers, Cabinet papers, Crown Law advice, Treaty analysis, constitutional advice, or other records relied upon by the Crown to support the position that sovereignty was lawfully ceded, transferred, or acquired.
In particular, please provide information addressing the following matters:
1. Who the Crown says held sovereignty prior to the alleged cession or transfer;
2. Who the Crown says had legal authority to cede, surrender, transfer, or otherwise bind others in respect of sovereignty;
3. The specific instrument, wording, clause, translation, or legal mechanism relied upon as proving any such cession or transfer;
4. Any official analysis addressing whether the persons or groups allegedly bound by that cession were expressly named parties to the relevant instrument;
5. Any official analysis addressing whether later collective terms such as “Māori”, “iwi”, “hapū”, or other modern legal/political descriptions are being applied retrospectively;
6. Any official legal basis relied upon for saying that persons, families, groups, or communities who were not expressly named parties to a treaty, contract, compact, or instrument became bound by it;
7. Any official advice or analysis addressing whether the parties alleged to have ceded sovereignty understood the wording relied upon in the same legal sense now asserted by the Crown;
8. Any official advice or analysis addressing the distinction between governance, kāwanatanga, sovereignty, ownership, authority, jurisdiction, and consent;
9. Any official advice or analysis addressing whether the Crown’s present constitutional position depends on assumption, treaty text, common law doctrine, statute, conquest, settlement, recognition, acquiescence, or another legal basis.
For clarity, this request is not asking for general public education material or broad historical commentary. It is asking for the official records, legal basis, and evidential material relied upon by the Crown.
If the Crown’s position is that sovereignty was acquired by a source other than consent or cession, please identify that source and provide the records relied upon.
If any part of this request is considered too broad, please do not refuse it without first providing assistance under section 13 of the Official Information Act 1982 to refine the request.
Please provide the information electronically.
Yours faithfully,
Tracy lynch
