OFFICIAL INFORMATION ACT 1982 REQUEST
Re: Biometric Systems, Digital Identity Frameworks, International Information-Sharing Arrangements, Oversight, and Public Accountability
To:
Ministry of Business, Innovation and Employment (MBIE)
The Treasury
This request is made under the Official Information Act 1982 in the public interest to better understand the decision-making, oversight, accountability, economic implications, and safeguards associated with proposed or existing biometric, digital identity, and cross-border information-sharing arrangements affecting New Zealanders.
There is increasing public concern regarding the expansion of biometric systems, international interoperability arrangements, digital identity systems, automated data-sharing capability, and the broader economic and administrative implications associated with such systems.
The purpose of this request is not merely to understand what systems or proposals may exist, but to identify:
• who is responsible for decision-making;
• what safeguards and oversight mechanisms exist;
• what economic and contractual arrangements may apply;
• what risks were identified;
• and what remedies or accountability mechanisms are available should harm, misuse, error, or disproportionate impact later occur.
Accordingly, please provide the following information:
1. Copies of any Cabinet papers, ministerial briefings, discussion papers, reports, memoranda, assessments, or correspondence held by MBIE or Treasury relating to:
• biometric information-sharing arrangements;
• international interoperability arrangements;
• digital identity frameworks;
• border-security data-sharing systems;
• or international agreements involving personal or biometric information.
2. Copies of any Privacy Impact Assessments, risk assessments, legal reviews, regulatory analyses, economic assessments, oversight reviews, or independent evaluations prepared in relation to such systems or proposals.
3. Identification of:
• the agencies involved;
• responsible ministers;
• approving authorities;
• advisory groups;
• contractors;
• technology providers;
• and any international partner agencies connected to such arrangements.
4. Copies of any documents discussing:
• data retention periods;
• algorithmic profiling;
• automated decision-making;
• behavioural analytics;
• facial recognition;
• biometric verification;
• or secondary uses of collected information.
5. Copies of any advice, reports, or communications discussing:
• economic impacts;
• commercial arrangements;
• public-private partnerships;
• operational efficiencies;
• cost-recovery models;
• or financial benefits associated with biometric or digital identity systems.
6. Clarification regarding:
• what public oversight mechanisms exist;
• how ordinary people may challenge or correct information;
• what complaint procedures exist;
• what audit processes apply;
• and what remedies are available where harm, misuse, or error occurs.
7. Identification of the individuals, offices, or decision-making structures responsible for:
• approving such systems;
• supervising implementation;
• assessing risks;
• and remaining accountable should adverse consequences arise.
8. Copies of any internal discussions, reports, or correspondence concerning:
• public concern;
• civil-liberty implications;
• sovereignty implications;
• privacy concerns;
• economic burden on the public;
• or long-term governance implications associated with such systems.
If any part of this request is more appropriately held by another agency, department, minister, or entity, please transfer the relevant portion of the request in accordance with section 14 of the Official Information Act 1982 and advise accordingly.
Electronic copies are preferred where possible.
This request is made in the public interest given the significant constitutional, economic, privacy, technological, and civil-liberty implications associated with these systems and arrangements.
Kind regards,
Tracy lynch
