OFFICIAL INFORMATION ACT REQUEST – FOLLOW-UP AND CLARIFICATION
Reference: Police OIA Response IR-01-25-46390
I refer to your response dated 1 May 2026.
While statistical information has been provided, the response does not address the central elements of the request, namely the policy framework, decision-making criteria, and proportionality considerations governing enforcement.
This correspondence is a refinement and clarification under section 13 of the Official Information Act 1982.
1. POLICY AND GUIDANCE (NOT PROVIDED)
Please provide:
1. All current and historical policies, guidelines, instructions, or memoranda used by Police and/or prosecutors when determining:
– Whether to investigate,
– Whether to charge,
– Whether to proceed by prosecution,
in relation to:
(a) Objectionable publication offences linked to terrorism content (including livestreamed or shared material), and
(b) Child exploitation material offences.
If no such documents exist, please confirm this expressly.
2. CHARGING THRESHOLDS AND KNOWLEDGE REQUIREMENTS
Please provide any documents, guidance, or training material addressing:
– The threshold for “distribution”, “sharing”, or “making available”, including:
– Hyperlinks
– Embedded content
– Third-party hosted material
– The required level of knowledge or intent, including:
– Whether awareness of content is required,
– How inadvertent or incidental sharing is treated,
– Any distinction between deliberate dissemination and passive conduct.
3. PROPORTIONALITY AND COMPARATIVE SERIOUSNESS
Please provide any records, briefings, or internal analysis that:
– Compare the relative seriousness of:
– Terrorism-related objectionable publications, and
– Child exploitation material offences;
– Address:
– Harm assessment,
– Public interest considerations,
– Deterrence rationale,
– Use of maximum penalties.
If no comparative analysis exists, please confirm.
4. ENFORCEMENT CONSISTENCY
Please provide:
– Any audits, reviews, or internal assessments concerning:
– Consistency of enforcement across offence categories,
– Regional or operational variation,
– Decision-making oversight.
5. DATA LIMITATIONS (ADMITTED IN RESPONSE)
You have stated that:
– Data relating specifically to Christchurch-related video distribution cannot be reliably isolated, and
– Narrative-based searches under-represent actual cases.
Please provide:
– Any documents acknowledging or analysing these data limitations,
– Any steps taken to improve classification, tracking, or reporting accuracy,
– Any guidance issued to staff regarding recording of such offences.
6. TRANSFER OBLIGATIONS
Where information is held by another agency (including the Ministry of Justice), I request that the relevant portions be transferred under section 14 of the Act, rather than refused.
7. DUTY OF ASSISTANCE
If any part of this request is considered too broad, I expect proactive engagement under section 13 to refine scope, rather than refusal.
8. FORMAT
I request:
– Copies of documents in full where possible,
– Redacted versions where necessary,
– Identification of any withheld material with reasons under the Act.
9. SUMMARY
The information provided to date is limited to statistical outputs and does not address:
– The legal and operational framework guiding enforcement,
– The thresholds for liability, or
– The basis for proportionality between offence categories.
These matters go to the core of lawful and consistent application of the law and remain outstanding.
I look forward to your response within the statutory timeframe.
