Legal risks associated with vaccination mandates affecting the health workforce
I write to refine my request under the Official Information Act 1982 following your response dated 31 March 2026 (Ref: H2026079580).
This refinement is made to reduce any possible grounds for refusal under section 18(f) and to focus only on clearly identifiable high-level decision material rather than general correspondence.
Refined request
I now request only the following limited categories of information held between 1 January 2020 and 31 December 2023:
1. Ministerial decision briefings
Any briefings provided to:
• Minister of Health
• Cabinet
• COVID‑19 Response Minister(s)
Which discuss:
• Legal risks associated with vaccination mandates affecting the health workforce
• Judicial review risks
• Employment or workforce impact risks
For clarity, I do not seek:
• emails
• general correspondence
• operational discussions
• litigation file material
Only formal decision briefings.
2. Crown Law engagement (high level only)
Confirmation of:
• Whether Crown Law provided advice regarding vaccination mandates affecting workforce legality
• Dates of any such advice
• The general subject description only
I do not seek privileged legal content.
Only existence, date, and subject description.
3. Document schedule – strictly limited
If held, please provide a document schedule limited only to:
• Cabinet papers
• Ministerial briefings
• Aide-memoires prepared for Ministers
For each document:
• Date
• Title
• Authoring agency
• Minister or body provided to
• General subject description
This excludes all other document types.
Further refinement to assist processing
To further reduce scope, this request is limited to:
Only documents prepared at:
• Tier 2 level or above
• Deputy Chief Executive level
• Chief Executive level
• Ministerial briefing level
This excludes operational level material.
Duty to assist
If any part of this request is still considered too broad, I request assistance under section 13 of the OIA to identify how it could be further refined rather than refused.
Public interest
Given the significant constitutional and employment impacts of vaccination mandates, there is a strong public interest in transparency regarding the legal risk advice considered at decision‑making level.
I look forward to your response.
