Nowhere in the legislation does it state the fine applies upon allegation. No conviction = no fine.
I am convinced all infringement notices from NZTA, Police & councils are illegal and void. Think speeding fines, parking fines, T2 lane violations etc. Why? They all quote section 40 of the Land Transport Act as justification to issue the infringement allegation notice. This section has 2 parts. Part 1 dictates when an infringement occurs (basically breaking a rule) and Part 2 says when a fine applies. Part 2 clearly states the fine applies upon conviction. Nowhere in the legislation does it state the fine applies upon allegation. No conviction = no fine. I have asked NZTA and NZ Police & AT how they justify issuing a fine when the legislation doesnt allow for it and none of them can provide an adequate answer. They are fleecing us and its time it stoppped.
