Re: OIA to NZTA about car stops

We have a full reply regarding their ability to do as they like. The only way you can contest them is if they do not follow their own procedures.

Their argument in court is they are not bound by contract but by statute. For now we are suggesting you put your registration on hold or continue to do WOFs and full registration and just put the stickers on the Car.

Re: OIA-20763 – Clarification of Independent Coercive Authority

From: Tracy Lynch

Kia ora,

I refer to your response dated 27 February 2026 (REF: OIA-20763), including Attachment 1 (MoUs), and your earlier response of 13 February 2026. This request seeks clarification of a narrow and specific issue arising from that correspondence.

1. Statutory Basis for Independent Coercive Authority

Please provide the specific statutory provisions NZTA relies upon to:

• • Compel compliance by members of the public
• • Direct a vehicle to stop
• • Seize or detain vehicles or property
• • Require production of identification or documentation

without reliance on sworn New Zealand Police officers.

Please also provide any internal document, legal interpretation, delegation instrument, or operational guidance currently in force (as at 1 January 2026) that states NZTA possesses independent coercive enforcement authority separate from Police powers.

If NZTA does not assert such independent authority, please confirm this explicitly.

2. Delegation Instruments

Please provide copies of any delegation instruments (current as at 1 January 2026) authorising NZTA officers or contractors to exercise coercive enforcement powers, and any document identifying the statutory source of such delegated authority.

If enforcement action must be exercised by sworn Police officers, please confirm whether NZTA staff lack independent authority to exercise those powers.

3. Reliance on Police Powers

Please provide any document describing the legal basis upon which Police exercise coercive enforcement powers at NZTA’s request or referral, and any document clarifying limits on NZTA action where Police involvement is required.

4. Confirmation of Absence (If Applicable)

If NZTA does not hold documents asserting independent coercive authority, please confirm that:

• • NZTA does not possess independent coercive enforcement powers absent Police authority; and/or
• • Coercive enforcement requires statutory authority exercised by sworn officers.

Kind regards,

Tracy Lynch
