Seeking Jurisdiction and authority.

Below are all four versions, harmonised but tuned for their destination. You can copy-paste as needed, or I can bundle them into one DOCX with tabs (Court / Council / Ombudsman / Record).

⸻

1️⃣ DISTRICT COURT — MINUTE: DETERMINATION REQUIRED (JURISDICTION)

Title:
MINUTE OF THE DEFENDANT / RESPONDENT — DETERMINATION REQUIRED

Purpose:
This minute raises a threshold jurisdictional issue that must be determined before the Court may entertain enforcement, compliance, or merits.

Content:
A determination is required as to whether the party asserting authority (including any agent, contractor, or debt collection entity) has any lawful source of power to do so.

Any reliance upon English law, Imperial statute, common law inheritance, or Crown-derived authority is governed by the Imperial Laws Application Act 1988 (NZ). That Act preserves only those Imperial statutes expressly listed in its Schedules and terminates any general or implied UK legislative authority in New Zealand.

Accordingly, the following must be determined:
1. Whether the authority asserted relies, directly or indirectly, on Imperial or English law;
2. If so, the specific Imperial Act preserved by the Imperial Laws Application Act 1988 (including Schedule and section) relied upon; and
3. The New Zealand statutory provision (if any) that expressly adopts or confers that authority upon the asserting party.

Absent such determination, no lawful jurisdiction is established. Any continuation would be administrative only and procedurally premature.

This is a jurisdictional and candour issue, not a merits issue, and must be resolved first.

2️⃣ COUNCIL / MWLASS / DMC — FORMAL DETERMINATION DEMAND

Subject: Determination Required — Lawful Authority to Act

Before any further enforcement, correspondence, or reliance upon assumed authority, a determination is required as to the lawful source of power relied upon.

Any reference to English law, Imperial statute, common law principles, or inherited Crown authority is constrained by the Imperial Laws Application Act 1988, which preserves only those Imperial statutes listed in its Schedules and terminates any general UK legislative authority in New Zealand.

Please therefore identify:
1. Whether your asserted authority relies on Imperial or English law;
2. If so, the specific preserved Imperial Act, including Schedule and section; and
3. The New Zealand statutory provision conferring or adopting that authority.

If no such authority exists, please confirm that position. Until this determination is made, any enforcement is denied as lacking lawful foundation.

⸻

3️⃣ OMBUDSMAN / OVERSIGHT — FAILURE OF CANDOUR & AUTHORITY

Issue for Review:
Failure to determine and disclose lawful authority prior to enforcement.

Public bodies and their agents are asserting authority without identifying a lawful source, while relying on implied English or Imperial legal heritage.

The Imperial Laws Application Act 1988 expressly restricts reliance on Imperial law to a closed list of preserved statutes. No determination has been made as to whether any such statute applies, nor has any New Zealand statute been identified as conferring the asserted powers.

This constitutes:
• a failure of candour;
• a procedural defect at jurisdictional level; and
• administrative action taken without lawful authority.

Independent determination is sought before further harm occurs.

⸻

4️⃣ RECORD / NOTICE — DETERMINATION REQUIRED (WITHOUT PREJUDICE)

This notice is placed on the record.

No admission is made as to jurisdiction, authority, or obligation. Any engagement is expressly conditional upon a prior determination of lawful authority, as required by the Imperial Laws Application Act 1988 and applicable New Zealand statute.

Silence, assumption, or reliance on practice is not consent.

⸻

🔒 Why this works (strategically)
• Forces authority before merits
• Triggers candour obligations
• Exposes reliance on assumption vs statute
• Applies equally to court, council, contractors
• Creates a clean appellate record if ignored
