Court Summons WHEN A COURT SUMMONS ARRIVES
Court Summons – Easy Read Guide + First Filing + Counterclaim Timing
EASYREAD – WHEN A COURT SUMMONS ARRIVES
This guide explains:
- What to do immediately when a District Court summons arrives
- What the first neutral court filing looks like
- The exact moment a counterclaim is filed
This is designed to keep things calm, orderly, and correct.
PART 1 – WHAT TO DO IMMEDIATELY
When a summons arrives:
DO:
- Stay calm
- Note the court, case number, charge, and hearing date
- Scan or photograph the summons
- Send it immediately to the Attorney’s Office
DO NOT:
- Contact Police Prosecution
- Email or phone the Court to explain
- File a defence or counterclaim immediately
- Mention OIAs or Ombudsman complaints yet
A summons is notice, not proof.
PART 2 – WHAT HAPPENS NEXT (QUIETLY)
While the summons exists:
- The 105 record already exists
- OIA(s) are running or pending
- Ombudsman escalation may be triggered
These processes continue quietly in the background.
Nothing is argued yet.
PART 3 – FIRST NEUTRAL COURT FILING
(Prepared by the Attorney)
The first filing is NOT a defence.
It is a procedural notice.
Purpose:
- To appear
- To preserve position
- To signal that disclosure and process issues exist
Typical form:
- Memorandum to the Court, or
- Notice of Appearance / Procedural Memorandum
Content (high-level):
- Acknowledge receipt of summons
- Confirm intention to respond procedurally
- Note that disclosure and accountability processes are underway
- Reserve all rights
This filing is calm, neutral, and non-adversarial.
PART 4 – WHEN THE COURT IS INFORMED OF PROCESS ISSUES
The Court is informed only when there is DOCUMENTED material, such as:
- An OIA deadline has passed without response
- Police have refused or limited disclosure
- An Ombudsman complaint has been lodged
- There is evidence of non-candour or procedural defect
At that point, the Attorney files a targeted memorandum or application.
PART 5 – THE EXACT MOMENT A COUNTERCLAIM IS FILED
A counterclaim is NOT filed:
- On receipt of the summons
- At the first appearance
- Before disclosure issues are documented
A counterclaim IS filed when:
- There is written evidence of Police non-compliance, non-candour, or misconduct
AND
- That evidence is externalised (OIA response, refusal, or Ombudsman involvement)
AND
- The Court has been placed on notice procedurally
This timing matters.
It prevents dismissal as premature.
PART 6 – SIMPLE TIMELINE
Day 0 – Summons arrives
→ Send to Attorney
Days 1–20
→ OIAs continue
→ No court argument
After Day 20
→ If no OIA response: Ombudsman complaint
→ If response received: Attorney review
After documentation exists
