Request for Audit Clarification – Rotorua Lakes Council (Disclosure of Known Risk) (Archived Newsletter)

Greetings
I am writing to seek specific clarification regarding audit coverage and disclosure obligations in relation to Rotorua Lakes Council, arising from documentary records now held by us.
By November 2025, Rotorua Lakes Council had formally received and logged a matter involving health, safety, and potential liability exposure in council-managed housing. The matter was acknowledged internally, assigned an executive reference, handled with legal involvement, and managed in a manner indicating recognised risk.
Given that context, I seek clarification on the following precise points:
1. Relevant audit period
Please confirm which audit or audits of Rotorua Lakes Council (financial year(s)) would reasonably be expected to capture:
– known legal claims,
– known insurance notifications or refusals,
– material health and safety risks,
– or contingent liabilities arising from council-managed assets.
2. Disclosure expectation
In the circumstances described above, should such a matter ordinarily:
– appear in audit risk registers,
– be disclosed as a contingent liability,
– or otherwise be visible within audit reporting to the Auditor-General?
3. Actual disclosure
Was this matter disclosed to the Auditor-General during the relevant audit(s)?
If so, please advise at a high level how it was assessed for materiality or risk.
If not, please advise how the audit framework addresses situations where documented internal knowledge of risk does not surface through audit channels.
This correspondence does not seek adjudication of the underlying dispute, nor does it ask the Auditor-General to investigate Rotorua Lakes Council at this stage. It seeks clarification on audit visibility, disclosure expectation, and system assurance.
Treasury and the Ombudsman are copied due to the potential implications for public finance oversight and administrative accountability should such matters remain undisclosed or unexamined across local authorities.
I am able to provide the relevant documentary record should that assist.
