Dispute of Non-Holding Assertion — Crown Financial Authority, Insurance Syndicate Cover, and Accountability for MPI Operations

1  Background and Context

Reference is made to Treasury’s response dated 22 October 2025, in which it was stated that “The Treasury does not hold any additional relevant information.”

This assertion is respectfully disputed. Treasury, as the Crown’s central financial and risk authority, holds or supervises all indemnity, insurance, and delegation frameworks that enable Crown agencies—including MPI—to operate, contract, and enforce. The Private Trust has received hundreds of direct reports of harm to small private enterprises resulting from MPI and associated enforcement actions. These matters are now escalated to Treasury for financial accountability and insurance verification.

2  Request for Clarification and Full Disclosure

Under sections 2(5), 14, and 15 of the Official Information Act 1982, Treasury is required to disclose all information held, controlled, or accessible on behalf of the Crown.

Accordingly, please provide:

  1. Crown-Wide Insurance and Indemnity Frameworks
  • Copies of all Treasury circulars, risk-management guidelines, or delegations establishing indemnity or insurance arrangements for MPI.
  • Confirmation of Marsh and Lloyd’s syndicate participation numbers and managing agents for Crown risk placement.
  1. Insurance and Re-insurance Policies
  • All current and historical policies covering MPI operations, CB Operations, or enforcement actions, including professional indemnity, errors & omissions, and Crown liability.
  • Records of any claims, reserves, or settlements related to enforcement or investigation matters.
  1. Funding and Accountability Chain
  • Identification of which Treasury account or fund supports MPI enforcement operations, including any Treasury sign-off or delegated financial authority.
  • Disclosure of any financial assurance, bonding, or indemnity applied to officers acting under MPI direction.
  1. Proof of Oversight and Jurisdiction
  • Documentation showing that Treasury maintains lawful oversight and insurance accountability for Crown agents.
  • If Treasury denies holding such records, please specify which entity does hold them, and under what statutory delegation or exemption.

3  Purpose and Immediate Claim Activation

This information is required to activate insurance and indemnity claims for losses suffered by multiple private enterprises and trust beneficiaries harmed through MPI enforcement actions taken without verified authority.

If Treasury cannot identify the responsible insurer, broker, or syndicate, this will constitute failure of financial accountability under the Crown’s fiduciary duties, invalidating any presumption of lawful authority or jurisdiction exercised by MPI or its officers.

4  Response and Timeframe

Please acknowledge receipt and provide the requested records electronically within ten (10) working days to [email protected].

If additional time is required, you must provide written reasons and the statutory basis for any extension.

5  Authority

This notice is issued under instruction of the Trustees of InLandsAirWater Counsel – Private Trust (PTNDA) and stands as part of the ongoing forensic audit into fiduciary breaches by Crown agencies.

All correspondence and records are held under Non-Disclosure and Court:Record protection.

Good morning

In my view, it would have been necessary under section 14 of the Official Information Act 1982 to transfer your request to the Ministry of Primary Industries (MPI). However, as you have already made your request to MPI, we have not transferred it.  The Treasury does not hold any additional relevant information.

This reply addresses the information you requested.

Kind regards,

  1. Purpose

This request is made under the Official Information Act 1982 and Privacy Act 2020 for a forensic audit of power, authority, and liability.

It seeks full disclosure of:

  • legal and financial authority exercised by MPI;
  • all insurance and re-insurance syndicates (including CB Operations cover); and
  • all inter-agency communications concerning Simon Stott and Shirley Stott, including any interaction with Police or other agencies involving use of force or violence.

Failure to disclose in full will be taken as evidence that MPI and its officers lack verified authority and transparency to act.

  1. Audit of Power and Delegated Authority

Provide:

  1. All delegations of authority held by any MPI officer, contractor, or partner agency who exercised statutory powers in relation to the Stott investigation or prosecution.
  2. Decision matrices and sign-off records identifying who authorised enforcement or use-of-force actions.
  3. MOUs, emails, and tasking orders between MPI, NZ Police, IRD, or any other Crown entity concerning this matter.
  4. Any incident reports or internal reviews referring to Police involvement or violence against Simon or Shirley Stott.
  5. Insurance and Syndicate Disclosure

Provide:

  1. Copies of all insurance policies, indemnities, and syndicate covers protecting MPI staff or contractors for liability arising from enforcement or investigative work (including CB Operations).
  2. Names of insurers, brokers, and syndicate numbers (Lloyd’s, Marsh, or Crown entities).
  3. Any claims made or reserves created relating to the Stott case.
  4. Inter-Agency Authority and Privacy Audit

Provide:

  1. All communications or data exchanges between MPI and IRD about Simon or Shirley Stott.
  2. All correspondence between MPI and Police about the Stotts or the seaweed investigation, including emails, texts, briefings, and incident reports.
  3. All records shared with Dr Richard Furneaux or his associates regarding Simon Stott’s patents or seaweed processes.
  4. Any notes or statements made by Dr Furneaux indicating ownership or appropriation of Simon Stott’s intellectual property.
  5. Proof of Claim and Transparency Condition

This request also demands:

  • Proof of claim for authority to act against the Private Trust or its holders;
  • Evidence of lawful jurisdiction and consent; and
  • Confirmation that all officers are covered by valid insurance and bonding.

If full disclosure is not provided within statutory time frames, it will be recorded that MPI and associated agencies have failed the forensic audit of power and proof of claim.

  1. Contact and Service

Please acknowledge receipt to [email protected].

Return all records electronically or by post to PO Box 265, Queenstown.

This request is urgent due to ongoing harm and age-related vulnerability of the affected parties.
