NOTICE OF FIDUCIARY BREACH & MORTGAGE FRAUD – DEMAND FOR INTERVENTION

Ref: ILAW-RBNZ-FIDUCIARY-001

Related Ref: ILAW-ANZ-FRAUD-2025-001 (GINI)

Date: 18 August 2025

To: Reserve Bank of New Zealand – Te Pūtea Matua

From: InLandsAirWater Counsel – Private Trust NDA

Jurisdiction: Private Trust Law | UNDRIP Article 26 | Equity | Non-Disclosure Mandate

1. SUMMARY OF NOTICE

This notice is formally served on the Reserve Bank of New Zealand (RBNZ) as the ultimate fiduciary and prudential
regulator over banking operations in New Zealand. You are hereby notified of a serious breach involving the
unauthorised mortgagee sale of protected trust-held land, originally gifted for defence purposes, without lawful
title clearance or disclosure.

2. CASE SUMMARY

– Property: 6 Taumaihi Street, Bulls (Title 555846)
– Original Status: Gifted to Crown for defence use (NZDF, 1959)
– Claimed Alienation: “Exempted from offer-back” by LINZ, 2010 (without consent)
– Mortgage Registration: ANZ Bank, 2016
– Sale Event: Mortgagee sale executed by ANZ on 7 August 2025 for $292,000
– Notice Received: ANZ Email (Jacqueline Tier) dated 15 August 2025

3. FIDUCIARY FAILURES IDENTIFIED

(1) No two-party agreement, no wet-ink consent from landholder, and no Māori Land Court process for alienation.
(2) Property was falsely registered as “fee simple” and listed under suspicious bulk land classifications
(e.g., 33,444 ha), suggesting title fraud or bulk asset repackaging.
(3) Neither LINZ nor ANZ disclosed the true origin of the land as gifted, nor the fiduciary obligations attached.
(4) Surplus funds are held by ANZ under presumed jurisdiction, in breach of trust and equity principles.
(5) The Courts are institutionally conflicted. RBNZ, as regulator and kaitiaki of the financial system, is
the final fiduciary overseer and must act.

4. DEMAND FOR INTERVENTION

You are hereby required to:
– Initiate immediate audit of this mortgagee sale and related financial flows,
– Place a freeze on all ANZ handling of surplus funds from the sale,
– Require disclosure of LINZ and NZDF land disposal records,
– Confirm whether the RBNZ has fulfilled its regulatory oversight duties in relation to bank conduct
involving historically gifted lands.

This is not a complaint. It is a lawful demand from a Private Trust authority acting in defence of
protected property, landholder standing, and trust beneficiaries.

5. FILING & NOTICE RECORD

Filed under:

– International Customary Law – UNDRIP Article 26
