Kia ora Anna,
Thank you for your response dated 15 July 2025. We now issue this rebuttal and notice for the administrative record.
- No Jurisdiction to Enforce Against Trust-Held Property
Your claim that “New Zealand law” applies uniformly to all vehicles is invalid when applied to property held under Private Trust, protected by a binding Non-Disclosure Agreement (PTNDA).
Statutory authority only binds legal persons, registered participants, and parties who have knowingly entered contract with the Crown’s corporate governance system. The InLandsAirWater Counsel is not a legal entity, and this standing has been acknowledged by your own courts.
You are reminded that trust property, clearly marked as such, falls under equity jurisdiction, not public administration. There exists no enforceable nexus unless contractually established — which has never occurred.
- Enforcement = Force = Lawful Breach
You repeatedly use the term “enforce,” which denotes coercion or compulsion. Under lawful jurisdiction:
– No agency may force compliance upon property held outside its corporate system
– The Trust has not consented to be governed under transport or registration statutes
– The use of emergency lights, threats, or demands against non-commercial private property is a misuse of authority and a form of intimidation
No statute overrides the right to move freely in peace when not engaged in commerce or harm.
- Corporate Presumptions Are Not Recognised
Your correspondence relies heavily on terms like “she/her” and corporate styling, which have no lawful effect or meaning within our trust structure.
The use of gendered identity pronouns, legal name constructs, or title-based roles demonstrates you are operating entirely in a commercial-legal capacity. That framework does not apply to an alive private party operating under a Private Trust.
These assumptions are not consented to, and any continued mischaracterisation will be considered deliberate misrepresentation.
- Disclosures Still Outstanding
Despite multiple lawful requests, your office has failed to provide:
– The name of NZTA’s public liability insurer
– The delegated authority instrument authorising NZTA or Police to override trust designations
– The lawful basis for initiating stops or using emergency lighting where no commercial activity or emergency exists
This is a breach of the Privacy Act 2020, the Public Records Act 2005, and fiduciary duty.
You are hereby given 7 calendar days to comply with these requests. Failure to respond will be taken as admission of liability and concealment.
- Notice of Breach and Fiduciary Harm
Each stop, search, or enforcement attempt upon trust-marked conveyances is now recorded as:
– Breach of contract
– Fiduciary trespass
– Interference with protected trust property
– Trigger of financial liability under NDA and insurer protocols
As the named officer and correspondent, you are now placed on notice of personal accountability.
Records of this interference will be escalated to:
– The U.S. Securities and Exchange Commission, under Executive Order 13818
– The UN Special Rapporteur on Arbitrary Detention and Property Seizure
– Relevant bond insurers and liability underwriters
- Offer to Resolve
We remain open to resolution through lawful, equitable means. You may:
– Escalate this notice internally
– Provide the requested disclosures
– Confirm in writing that no further interference will occur with trust-held conveyances
If you choose to ignore this formal rebuttal and continue operating under false legal presumptions, your office and agents will be treated as acting outside lawful authority.

Kia ora Tracy,
Thank you for your correspondence regarding enforcement actions involving a vehicle held under a Private Trust structure.
Further to our response under OIA-18700, we acknowledge your position, and the concerns raised. However, it is important to clarify that under New Zealand law, all vehicles operating on public roads, regardless of ownership, are subject to the Land Transport Act 1998 and associated regulations. There is no recognised separate jurisdiction for Private Trust vehicles in relation to road rules or vehicle registration.
Public law agencies, including NZ Transport Agency Waka Kotahi (NZTA) and the New Zealand Police, are empowered to carry out compliance checks, issue enforcement notices, and take necessary actions to ensure public safety. These powers apply uniformly to all road users.
The assertion that vehicles operating under a Private Trust are exempt from administrative enforcement is not supported by any statutory provision or judicial precedent currently recognised in New Zealand.
While the Trusts Act 2019 governs the administration of trusts, it does not confer immunity from public law obligations, including those related to vehicle registration, licensing, or road safety compliance.
Additionally, the use of Non-Disclosure Agreements (NDAs) does not limit or prevent lawful enforcement by public agencies. NDAs are private contractual arrangements and cannot be used to restrict statutory powers or obligations.
We trust this clarifies the legal framework under which NZTA and other public agencies operate. As the matters raised have already been addressed in our response to OIA-18700, we do not have further information to provide at this time.

Subject: Request for Liability Insurance Disclosure and Accountability – Private Trust Vehicles
Anna,
Thank you for your response.
However, your suggestion that we have not provided specific vehicle information is incorrect. Over the past year, multiple communications have been submitted to NZTA and associated agencies regarding vehicles registered under Private Trust protections, including number plates and the legal status of those vehicles. These details have been consistently ignored or dismissed.
We now formally request the following:
1. Disclosure of NZTA’s liability insurance provider(s), including any policies or indemnities that cover wrongful enforcement or misidentification of vehicles operating under Private Trust jurisdiction.
2. Confirmation of the limits of authority delegated to NZTA and its agents in relation to vehicles that are clearly marked and protected by binding Private Trust Non-Disclosure Agreements.
3. Clarification of the lawful basis for roadside stops involving vehicles not engaged in commerce, where emergency lights were used outside the scope of an emergency.
It is important to reiterate that Private Trust vehicles are not commercial vehicles, and as such are not lawfully subject to administrative enforcement under transport legislation designed for corporate entities. The repeated targeting and stopping of these vehicles constitutes a breach of trust, fiduciary harm, and interference with private contractual agreements.
Further, every time a Police officer or NZTA affiliate detains, questions, or imposes a demand upon a Private Trust vehicle holder — especially while ignoring valid trust identifiers and markings — this triggers a breach of our NDA and causes chargeable harm.
You are hereby placed on notice that this conduct may result in formal invoicing and insurance claims being lodged against both NZTA and its named officers, including yourself, in your personal capacity.
We invite you to provide a suitable pathway to resolution or escalation within your office. However, failure to respond with transparency and accountability will compel us to take further steps to secure remedy through other lawful means.
We appreciate your urgent attention to this matter.

Thank you for your emails.
To look into this matter further, we will need specific details about the vehicle(s) in question, including registration numbers, and a clear explanation of what you are requesting or seeking to resolve.
Once we have this information, we will be in a better position to respond appropriately.
Ngâ mihi
