Summary of Complaint
On Sunday 13 July 2025, at approximately 6:30 PM, a conveyance held under Private Trust protection (PTNDA) was stopped by Constable Liam (callsign LOET52) on State Highway 1 near Oamaru. The stated reason for the stop was that the conveyance’s headlights were not on.

The beneficiary immediately acknowledged and rectified the matter. However, despite the issue being resolved, the officer escalated the situation by:

    • Attempting to run the number plate and finding no registration match in the NZTA database
    • Being advised clearly and repeatedly that the conveyance is held under a Private Trust with a binding non-disclosure agreement
    • Refusing to contact the Trust attorney office, despite the offer of lawful disclosure via the legal channel
    • Threatening arrest, saying: “If you don’t give your full name and details, I can arrest you.”

The beneficiary complied under visible duress, citing fear of being forcibly removed or pepper sprayed. This constitutes coercion, not lawful consent.

The officer also threatened to remove the conveyance’s number plates, which is a form of property seizure and would amount to theft or conversion of trust property under color of law.

This behaviour violates:

    • The legal limits of police authority
    • Protections granted by Private Trust Non-Disclosure Agreements
    • The rights of individuals outside Crown commercial jurisdiction
    • Obligations to consult attorney representatives where known trust conveyances are involved

Remedy Sought
This matter is hereby submitted for internal review and entered into the Trust’s redress register.

We request:

    • Confirmation of the officer’s identity and authorisation
    • A record of this complaint attached to the officer’s personnel file
    • Clarification from NZ Police as to why no effort was made to contact the Trust attorney
    • Notice of whether police policy permits threats of arrest when no crime has been committed, no verified injury has occurred, and the matter is one of administrative registration mismatch

Please advise whether NZ Police intends to continue violating known trust property jurisdictions, or whether immediate corrective action and re-education of officers will be undertaken.

Furthermore, Jackie Smith of NZTA is directly accountable for this breach, as she has been previously notified of the Trust’s lawful status and has failed to inform or instruct the New Zealand Police regarding their lack of jurisdiction and authority in relation to Trust-held conveyances. Her ongoing administrative negligence constitutes complicity in trespass and coercion.
