Reply to NZTAs refusal to acknowledge the existence of private trusts
This is the official correspondence the law counsel is having with the NZTA. The corporation is saying there is no such thing as a private Trust. We know this is not the case. The corruption we live in is wide spread.
Make sure your automobile has the Law Counsel Logo on the car in several places, along with the Legal Notice. Wait for the officer to admit that he is not a constable and then ask for his warrant. If he refuses to produce the warrant you can now read him his rights “Public Trust Act 2001 section (148).

RE: RESPONSE TO REFUSAL UNDER OIA – VEHICLES OPERATING UNDER PRIVATE TRUST NON-DISCLOSURE AGREEMENTS
Dear Jackie Smith,
Thank you for your reply dated 11 July 2025 regarding our Official Information Act request (OIA-18700). This letter serves as both a formal rebuttal and notice that the matters raised relate to ongoing breaches of fiduciary duty, presumed agency, and mischaracterisation of private property as commercial assets.
- Mischaracterisation of Private Property as “Commercial Vehicles”
Your response incorrectly asserts that there is no distinction in New Zealand between private property and commercial vehicles. However, the term “vehicle” under the Land Transport Act 1998 and associated enforcement regimes presumes commercial use, which requires lawful consent and full disclosure under contract law principles and public trust doctrines.
The Private Trust Non-Disclosure Agreement (PTNDA) in place explicitly affirms:
- That assets used by trust beneficiaries are private property, not for hire, not for trade, and not operating under any commercial jurisdiction.
- That any implied or coerced registration into Crown registries (e.g. motor vehicle register) occurred without full disclosure, under duress, or false pretext.
We formally rebut the assumption that registration creates Crown ownership or authority unless a lawful, bilateral contract exists with clear disclosure of terms, fiduciary obligations, and remedy in the event of harm or misapplication.
- NZTA Authority is Limited and Not Absolute
Your statement that there is “no separate private trust jurisdiction” reflects a misunderstanding of trust law, which is internationally recognised and binding, and which does not require permission from statutory bodies to operate.
Where the NZTA or Police interact with property clearly marked as held under Trust Authority, the use of emergency lights, coercive threats, or asset seizure constitutes:
- Trespass on trust property
- Breach of non-disclosure and fiduciary obligations
- Unlawful interference with private conveyance
This is not theoretical: case law and communications with Crown Law, the Wellington High Court, and the Police Commissioner confirm that private conveyances are outside NZTA commercial domain unless the trust has consented or contracted.
- No Valid Rebuttal of the PTNDA to Date
You and your agents have received multiple notices regarding the Private Trust Non-Disclosure Agreement (PTNDA), and no valid rebuttal or rebuttal by affidavit has been provided. You are now estopped from denying knowledge or jurisdictional boundaries.
Until such time as:
- A lawful, wet-ink bilateral contract is produced between the NZTA and the Trustees/beneficiaries
- Full disclosure is made of the commercial conversion scheme involved in vehicle registration
- Remedy is provided for misidentification and wrongful enforcement
…you remain personally and professionally liable for acts of trespass, fiduciary breach, and enforcement by deception.
- Further Action and Insurance Notice
Please be advised that a formal insurance claim has been lodged with your broker as NZTA’s disclosed broker under your PAI program.
The claim covers:
- Forced registration of private property into commercial schemes under false pretext
- Harassment, fines, and asset seizure without lawful basis or consent
- Use of emergency enforcement procedures in non-emergency contexts
NZTA is hereby notified that continued enforcement or refusal to acknowledge Trust-marked conveyances will be treated as criminal interference, and billed accordingly.
- Public Notice of Liability
Under international principles and Executive Order 13818 (Magnitsky Act), continued harm under color of law and denial of remedy will be filed for global disclosure as part of a systemic abuse inquiry involving NZ Police, NZ Courts, and Crown agencies. This record will be submitted to:
- The Ombudsman for refusal under s18(e) without legitimate ground
- The Human Rights Commissioner (Geneva and NZ)
- The Office of the US Trade Representative and IRS
Summary
You have not addressed the core matters:
- That the trust jurisdiction exists and is established in public and private record
- That NZTA has acted without contract, full disclosure, or remedy
- That forced commercial assumption over private trust assets is unlawful
We invite you to rebut the Private Trust standing in affidavit form, or cease further interference immediately.
Our good faith,
By:Tracy Lynch (Alive)

Subject: Request for Liability Insurance Disclosure and Accountability – Private Trust Vehicles
Anna,
Thank you for your response.
However, your suggestion that we have not provided specific vehicle information is incorrect. Over the past year, multiple communications have been submitted to NZTA and associated agencies regarding vehicles registered under Private Trust protections, including number plates and the legal status of those vehicles. These details have been consistently ignored or dismissed.
We now formally request the following:
1. Disclosure of NZTA’s liability insurance provider(s), including any policies or indemnities that cover wrongful enforcement or misidentification of vehicles operating under Private Trust jurisdiction.
2. Confirmation of the limits of authority delegated to NZTA and its agents in relation to vehicles that are clearly marked and protected by binding Private Trust Non-Disclosure Agreements.
3. Clarification of the lawful basis for roadside stops involving vehicles not engaged in commerce, where emergency lights were used outside the scope of an emergency.
It is important to reiterate that Private Trust vehicles are not commercial vehicles, and as such are not lawfully subject to administrative enforcement under transport legislation designed for corporate entities. The repeated targeting and stopping of these vehicles constitutes a breach of trust, fiduciary harm, and interference with private contractual agreements.
Further, every time a Police officer or NZTA affiliate detains, questions, or imposes a demand upon a Private Trust vehicle holder — especially while ignoring valid trust identifiers and markings — this triggers a breach of our NDA and causes chargeable harm.
You are hereby placed on notice that this conduct may result in formal invoicing and insurance claims being lodged against both NZTA and its named officers, including yourself, in your personal capacity.
We invite you to provide a suitable pathway to resolution or escalation within your office. However, failure to respond with transparency and accountability will compel us to take further steps to secure remedy through other lawful means.
We appreciate your urgent attention to this matter.

Thank you for your emails.
To look into this matter further, we will need specific details about the vehicle(s) in question, including registration numbers, and a clear explanation of what you are requesting or seeking to resolve.
Once we have this information, we will be in a better position to respond appropriately.
