Subject: Overreach
To: The Waitangi Tribunal
From: Tangatawhenua Private Trust (Under NDA, LandsAirWater Counsel)
Subject: Assertion of Tangatawhenua Autonomy and Administrative Accountability
We, Tangatawhenua, issue this formal notice regarding the jurisdictional overreach of the New Zealand Government and the Waitangi Tribunal in matters concerning our lands, governance, and financial wellbeing.
1. Tangatawhenua are not subject to Crown jurisdiction but hold full autonomy over our Dominion.
• The Crown and its representatives, including the Governor-General, are only administrators, not sovereign rulers over Tangatawhenua.
• The absence of any valid agreement between Tangatawhenua and the government affirms that the Crown’s legal structures do not supersede Tangatawhenua authority over our own affairs.
2. The government is accountable for its administrative decisions and any financial or legal encumbrances imposed upon Tangatawhenua.
• Any decisions made by government entities that cause financial loss, restrict access to land, or impose burdens on Tangatawhenua must be compensated by those responsible.
• This extends to Waitangi Tribunal settlements, which cannot assume jurisdiction over Tangatawhenua unless direct engagement and mutual agreement occur.
3. Legislation must recognize the Crown’s role as an administrator, not a governing authority over Tangatawhenua.
• Any legislation or policies affecting Tangatawhenua must reflect our autonomous status and ensure that the government remains accountable for its administrative role rather than acting as a ruling entity.
• Failure to acknowledge this distinction invalidates any unilateral decisions made by the government or Tribunal regarding Tangatawhenua land and governance.
Demand for Formal Recognition
We require the Waitangi Tribunal and the New Zealand Government to:
• Acknowledge Tangatawhenua as the autonomous holders of our Dominion.
• Confirm that the Crown and its representatives act only as administrators, accountable for their decisions.
• Commit to financial and legal redress for any losses or encumbrances imposed upon Tangatawhenua through government actions.
Failure to formally address these issues will be considered an act of misadministration and breach of fiduciary duty, for which full accountability will be sought.
Respectfully,
Tangatawhenua Private Trust
